Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of Feedbyte's websites, applications, kiosks, APIs, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization.

If you do not agree to these Terms, do not use the Services.

2. The Services

Feedbyte provides an operational customer feedback platform that helps organizations capture, analyze, and act on feedback across locations and stations, including surveys, QR codes, kiosks, reporting, tasking, and related features. We may update, modify, or discontinue features from time to time. We will use reasonable efforts to avoid material disruption and to communicate significant changes when practicable.

3. Accounts and Eligibility

  • You must provide accurate account information and keep it up to date.
  • You are responsible for maintaining the confidentiality of your credentials and for activity under your account.
  • You must promptly notify us of any unauthorized use of your account.
  • You may not use the Services if you are barred from doing so under applicable law.

4. Customer Data and Feedback Content

You retain ownership of data you and your end users submit through the Services (“Customer Data”), including survey responses and related operational content. You grant Feedbyte a limited license to host, process, transmit, and display Customer Data solely to provide, maintain, secure, and improve the Services, and as otherwise described in our Privacy Policy.

You are responsible for having a lawful basis to collect Customer Data and for configuring surveys, kiosks, and QR flows in a manner that complies with applicable privacy and consumer laws.

5. Acceptable Use

You agree not to:

  • Use the Services for unlawful, deceptive, harassing, or abusive purposes
  • Attempt to gain unauthorized access to the Services, other accounts, or underlying systems
  • Interfere with or disrupt the integrity or performance of the Services
  • Reverse engineer, scrape at abusive volumes, or misuse APIs except as expressly permitted
  • Upload malware or content that infringes third-party rights

6. Subscriptions, Trials, and Fees

Paid plans, trials, and billing terms may be presented at signup or in a separate order form. Unless otherwise stated, fees are non-refundable except where required by law. We may change pricing with notice for upcoming renewal periods. Failure to pay may result in suspension or termination of access.

7. Intellectual Property

Feedbyte and its licensors own all right, title, and interest in the Services, including software, branding, documentation, and design. These Terms do not grant you any rights to our trademarks or other intellectual property except the limited right to use the Services as permitted herein.

8. Confidentiality

Each party may receive non-public information from the other. The receiving party will use that information only to perform under these Terms and will protect it with reasonable care. Confidentiality obligations do not apply to information that is public, independently developed, or rightfully received from a third party without duty of confidentiality.

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEEDBYTE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEEDBYTE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO FEEDBYTE FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You will defend and indemnify Feedbyte against claims, damages, and expenses arising from your Customer Data, your use of the Services in violation of these Terms, or your violation of applicable law or third-party rights.

12. Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms, create risk or legal exposure, or fail to pay fees when due. Upon termination, your right to use the Services ends. Provisions that by their nature should survive will survive, including ownership, confidentiality, disclaimers, and limitations of liability.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date on this page. Material changes may be communicated through the Services or by other means. Continued use after an update constitutes acceptance of the revised Terms.
